Terry L. Davis and Jacqueline D. Davis as individuals, and Terry L. Davis as administrator of Ronald Davis estate, appeal the district courts order granting summary judgment to the municipal defendant. The district court held Davis had failed to produce "significantly probative evidence" of the existence of a municipal policy or custom as required under 42 U.S.C. section 1983. Alternatively, the district court held the actions of the chief of police did not amount to gross negligence or reckless indifference. We affirm.
